MA Firefighter Accused of Nude Dare Ends Case

The now-retired Lynnfield fire captain entered a plea that maintains his innocence but acknowledges there is sufficient evidence to prove guilt.

NEWPORT, RI—The former Massachusetts fire captain who allegedly walked into the 7-Eleven on Aquidneck Avenue in Middletown nude on April 3 had his disorderly conduct charge filed in District Court on Monday, meaning it will be removed from court records one year from April 3 provided he does not face any additional charges.

The woman behind the counter on that day in April told police that John H. Walsh, 60, of Lynnfield, was completely naked when he walked up and paid for a Coke.

Middletown police were told Walsh drove away from the store in a black Mercedes-Benz with a Massachusetts license plate. An officer pulled the vehicle over near the intersection of Miantonomi Avenue and Broadway, The Daily News previously reported.

Walsh's girlfriend, 29-year-old Tammy McDougal, was a passenger in the car. She told the officer that she had dared Walsh to walk into the 7-Eleven and buy a soda with no clothes on because he had said it was legal to be naked in Rhode Island, The Daily News previously reported, referencing the Middletown police report.

On Monday, Walsh entered an Alford plea — in which the defendant maintains innocence but acknowledges there is sufficient evidence to prove guilt beyond a reasonable doubt. Judge J. Terence Houlihan, Jr. ordered Walsh to complete 10 hours of community service — which he had already completed at a soup kitchen in Lynn, Massachusetts, according to court records — make a $500 contribution to Lucy's Hearth — which Walsh made on Sept. 22, according to court documents — write a letter of apology and pay $96.75 in court costs.

A phone call to attorney Matthew Marin, who represented Walsh, on Tuesday was not immediately returned.

Lynnfield Fire Chief Glenn Davis told the Daily Item of Lynn, MA, soon after the incident that Walsh was placed on paid administrative leave pending an investigation. Davis told The Daily News on Tuesday that Walsh had retired from the Lynnfield Fire Department.
