Can the department you work for deny a injury claim if you were wearing non-issue, but compliant gear(ie:boots, helmet, gloves, etc.)? We were recently told that we could no longer use any flashlights(and other gear things)personally purchased, during our course of duty. This just seems completely opposite of the whole mind-set of being a firefighter, using any equipment available to save the most for the most people. The dept. I work for issues a difficult to use flashlight that points at the floor and requires 1 hand to hold it straight, and many of us have bought the BIG-ED right angle flashlight because its more useful and it sounds like we will be ordered to take them off. Very frustrating.

I believe they can tell you what you can and can not use. Thats a sticky one you might want to have a lawyer or union rep check into. So many what if scenario's! Damn - thats a messy question - but a good one!

True; its messy and yet understandable. So all i can say is to make recommandations to the Chief as what gear works better to do your job the best you can. Im sure he will understand, and if enough guys back you then the Chief should be getting you the right stuff. Anyway, just stay safe with what you got. Good Luck :D

now, you brought up a flashlight. that isn't gear. it isn't protective equipment. if it fails, you won't directly result in injury to you. similar equipment would include door chocks, rubber strab for helmet, leather work gloves for non-structural firefighting. as long as you don't modify your gear, or use non-authorized gear for your PPE, they shouldn't be able to reject your claim.

Can they, sure. Their department, their rules. Perhaps it came from the departments insurance carrier. Maybe you should ask. I do think its strange that they mention flashlights. A helmet or hood I can see, but a flashlight?
