OREM -- A fatal shooting upset a quiet afternoon in an upscale neighborhood in Orem Sunday. Police took the victim's brother-in-law into custody.

The victim, whom police have identified as 51-year-old Marvin Sidwell, lived in the basement of a home near 400 South and 300 West with his mother. The man in police custody is married to Sidwell's sister and was visiting the home at the time of the shooting.

The shooting happened in the basement just after 12:30. Police said the only people at home were Sidwell, his brother-in-law and the Sidwell's elderly mother. She was later escorted out of the house by police.

Authorities have not released any details about what provoked the shooting. They responded to a phone call saying someone had been shot.

Investigators escort the victim's mother out of the house Sgt. Craig Martinez with the Orem Department of Public Safety said, "We had one person that had a weapon and so we've taken him in. We're going to be talking to him about what happened."

Martinez said when officers arrived, they instructed the brother-in-law to come out of the house. His wife came to the scene later.

Police said they were unaware of any previous trouble or police involvement at the house.

They would not immediately release the brother-in-law's information, but called him a person of interest in the shooting. No formal charges have been filed.
