any firefighter who has been fired for smoking may have a way around this law

The reason this law exists is to protect your heart, hypertension and cancer presumptive benefits. Why would you want to mess that up?

firefighter smoking law
I am not trying to go against the Mass. smoking law I am in a town which just had a firefighter in violation of the law . They had him resign as a firefighter , then rehired him as a Capt.Two members of the board voted against rehiring this person stating they felt it was not legal to do so.The chairman of the selectboard acknowledged that they were violating M.G.L.40 sec 101a,but does not care.He publically stated he would "let Southampton be the test case" I am just afraid how this will affect the rest of firefighters and police officers if public officials start ignoring this law??
