It doesn't matter. The definition of homemade fireworks and improvised expolsive device is exactly the same and they are illegal. There is no provision in any of the explosive device laws that I am familiar with that provides and exemption for so-called fireworks.
LISTEN UP CLASS:
If you are involved in preparing or executing a search warrant in this type of case, make sure that the warrant includes cameras and video cameras. Kids very often will video tape their illegal activities.
The affidavit wording will go something like this:
"The affiant also seeks judicial sanction to seize any and all cameras, video tape recorders, video telephones, and any other electronic device used to capture photographic or digital images. i also seek judisical sanction to seize and view any recording medium found. The affiant has knowledge and experience that perpetrators of violent criminal activity involving fire, explosives or pyrotechnics will often record their illegal activities on digital, photographic or video recording mediums for the purpose of documenting their activities and sharing the accounts of their illegal activities wil other like-minded individuals."
The judge may or may not agree. But it does not hurt to ask. I promise you that this addition will reap tremendous dividends over the course of your career.

Building an explosive device like that is bad enough, but what would possess them to set it off in the middle of a street like that???

Should inform the kids that they are being sent to Guantanamo Bay for setting off an IED. That would scare me from ever doing it again

I dont know I dont think kids these days get scared to much. They know mom/daddy/lawyer will get them out of it.Originally posted by Pretender764
