Former EMT gets prison term for fatal defibrillator prank

    Associated Press
    Mar. 15, 2006 09:55 AM

LEBANON, Va. - A former emergency medical technician who jolted a co-worker with cardiac defibrillator paddles as a prank and ended up killing her was sentenced to five years in prison.

Joshua Phillip Martin, 25, cried and apologized to Courtney Hilton Rhoton's family Tuesday before he was sentenced. He pleaded guilty to involuntary manslaughter in January.

Russell County Circuit Judge Mike Moore suspended four years of the sentence, leaving Martin, who had no criminal record, with just under one year still to serve.

"I hope when you get out you get on with your life," Moore said. "You have the ability to help people, and I hope you do. Courtney deserved that."

Rhoton, 23, died in June, three days after the jolt from the defibrillator, used to restart patients' hearts with an electric current.

Her half-sister, Chanda Lawson, told the judge Martin deserved a life sentence. "I hope when he lays down at night he remembers those two kids don't have a mommy anymore because of the foolish thing he done," she said.

Such a shame that the young man's life is ruined for 5 seconds of stupidity. Even bigger shame that a young woman's life is lost for 5 seconds of stupidity.

What else did you all expect the court was going to do? Pin a medal on this twip. He should have received more time for this. Any how, is has screwed up his life and will be banded forever for working in the fire service or ems, because of his actions.

Five Years ? That's it ? Absolutley Outrageous. Sure his intention wasn't to kill anyone I'm sure but I know it's taught that defib units can be lethal if not used properly. What was this guy thinking ?

Sure he's sorry now spending 5 years from which I understand 4 of them are suspended basically he'll be behind bars for a year if that. -- His action of stupidity cost a life and more than anything else took a mother away from her children.

I know....you can hear it now...

"Hey boy.....you look mighty fine in them thar pants, and you got such a pretty face....why don't you c'mere a minute.."

He should get a minimum of 10, for obvious negligence. He was well aware of what a defib is capable of.

One year for contributing to the death of another just doesn't quite seem like enough punishment.
He had to know that the defibulator was dangerous. If he didn't, then he had no business being an EMT.
I feel sorry for the victim's family. They were looking for justice and instead got a civics lesson on just how weak our judicial system really is.
Sad in more ways than one.

Appreciate the follow up. I heard about this incident last August but had never heard what the outcome was. Thanks again.
