State Law in NY is no smoking in any govermental building...my cities policy...no smoking while on city property....fire trucks ....fire ground....ect. The police department made an exception to the rule...they allow smoking in one patrol car after 12 midnight but before 5 AM

Does the city have a policy for the heart/lung bill. Do the firefighters have to sign a cotract not to use tobacco on/off duty?

We do not sign anything when we come on the job...but the city follows state law when it comes to smoking...and its states that you can't smoke on govermental properties. In NY we have a presumptive Heart/Lung Bill....but it always an uphill battle if your a smoker.

the question is not weather we are on city property but why cant we smoke or chew on our own time. i am looking for legislative issues to back us up. L-1132

Our career firefighters are prohibited from tobacco use when on OR offduty. We represent the City of Mankato, regardless of if we're on a call, at a bar, or shopping for groceries.

I'm a member of a large all-career department that has required everyone hired since 1999 to sign a non-smoking-policy, which applies on and off duty.
Thus far, no one has challenged it.

You are going to have a tough fight with this one. Lung cancer has become a job related injury. If your department can show that you smoke it is possible that your pension or duty injury payments may be stopped because smoking could have caused the cancer. By having you sign a contract stating that you will not smoke they are actually protecting you from nonpayment if you were to get lung cancer and had to end your career.

Smoking on the job
I find it odd that you can not smoke on the job,because it may kill you. Well so can your job. It is like telling someone in combat not to smoke because it is bad for your health.

how can any city or town offer their employees the heart and lung bill/benifites
to those who smoke. we have fought very hard to get this legislation passed.
we know what smoking does to the body. the same that happens on the fireground. but now we have a benifit for that part of our job and the consequences that come from it. our legislation was passed in1998-1999. as for enforcement, we just fired on of our new members for smoking(no great loss).
