    A 26-year-old man who brutally raped two Victoria teens was sentenced Thursday to 10 years in prison, prompting the Crown to consider an appeal.

    "We're going to have to review the decision," Crown counsel Ruth Picha said outside of the courthouse, adding that a decision on whether to appeal has not been made.

    Jacob Tree pleaded guilty to sexual assault for the rape of a 17-year-old he met on the streets of Victoria Feb. 1, 2004. Tree lured the victim to an isolated, crudely constructed lean-to across from the Johnson Street Bridge in Vic West and raped her. It was her first sexual experience.

    Tree also pleaded guilty to sexual assault causing bodily harm for binding, beating and raping a 19-year-old two weeks later. He robbed the till at Booster Juice health food snack bar in the Cook Street Village just after it opened and forced the employee into a back room. He punched her in the face when she screamed, tied her up and sexually assaulted her.

    At Tree's sentence hearing, Picha noted the maximum sentence for sexual assault causing bodily harm is 14 years. For sexual assault, the maximum is 10 years. Picha called for the two sentences to run consecutively so they would add up to a total of 15 years.

    With the sentence handed down, Tree could be out in roughly six years.

    Defence lawyer Bea Curry had suggested a prison term of four to six years. Curry said outside the courthouse she thought the sentence was "fair."

    "It strikes a balance between not being an excessive sentence, which I think the Crown was asking for, and not being too short. I think it addresses the issues," she said.

    She noted Tree's life has been a nightmare. He was raised by a neglectful and abusive mother who drank. His father left when he was two. He suffered sexual abuse at a young age, worked as a male prostitute and became addicted to heroin, which he has since kicked.

    In sentencing Tree, Justice Paul Williamson said he considered the sexual assaults to be of the "very worst type" that will "neither be accepted or tolerated by the citizens or the courts of this country."

    He noted that psychiatrists testified Tree is neither a sexual sadist nor a psychopath, is genuinely remorseful and accepts responsibility for his actions.

    Williamson sentenced Tree to serve four years for the sexual assault and six years for the sexual assault causing bodily harm. The sentences are to be served consecutively, on top of the sentence just exceeding a year Tree is serving for an assault in Alberta.

    As a sex offender, Tree must report to authorities for 20 years and is banned for life from possessing weapons.

    Outside the court, an internal investigation by Victoria police has determined Tree went to the front counter of police headquarters between the two attacks, acting Insp. Les Sylven said.

    Tree has said he tried to turn himself in to police. That sparked the investigation, which included a look at police video camera footage and computer records. "We believe he came in, and his name was run and there were no warrants for him," Sylven said.

    It is not known whether Tree tried to turn himself in, or merely asked if there was a warrant for his arrest, said Sylven. The cameras in the lobby do not record audio. Tree came in to the station either Feb. 14 or 15 and left when told there was no warrant.

    Within two days, he would commit the Booster Juice assault. Sylven said the investigation continues.

    Rick, its the same th world over. A 15 year old who raped an 11 year old girl in the toilets of a supermarket got 9 years over here. He'll be out in 1/2 that.

    And what kills me about the flaming liberals who think that these sentences are acceptable (and that includes the judges who issue these sentences) is that these scumbag pedophiles will never live near them, nor would they ever think to invite these bastards to stay in their house with them.

    And they cannot be reformed, yet the continue to let these people out to roam the streets. Then are utterly shocked when they rape and molest again.

    Ya, and I guess that none of these Judges or Laywers who think like this have ever had anyone close to the experience of being raped. I wonder if their tune would change if it happened to them. Would they reflect on the "light" sentences as "being fair", I wonder? I'll bet they would be storming the gates, demanding the greatest punishment possible.

    Sigh... what a wonderful world we live in............ sometimes anyhow....

    Rick, it is a double standard for alot of them. I remember former New York governor Mario Coumo. He said he would never support the death penalty in NY, but that if someone killed a family member, he wanted that person put to death.

    The sentances are way to lenient.

    Then are utterly shocked when they rape and molest again.
    Yeah they are like "didnt you learn your lessson"? Well hello of course not they were only in jail for 3 years. I think this statement is true with most criminals, that people are shocked when they commit crimes again and even more surprised when they commit the same one again that they went to jail for in the first place. There should be no second chances with crap like that.

    Ohio Man Claims Right To Have Sex With Boys
    Admitted Pedophile Says Children Can Consent

    CLEVELAND -- It was probably not a defense the court had heard before.

    A suburban Cleveland man accused of sexually assaulting nine disabled boys told a judge Wednesday that his apartment was a religious sanctuary where smoking marijuana and having sex with children are sacred rituals protected by civil rights laws.

    The admitted pedophile offered a surprising defense Wednesday to 74 charges of rape, drugs and pandering obscenity to minors.

    Appearing in an Ohio court for a pretrial hearing, Phillip Distasio, 34, of Rocky River, Ohio, said he was a pedophile.

    He told the judge, "I'm a pedophile. I've been a pedophile for 20 years. The only reason I'm charged with rape is that no one believes a child can consent to sex. The role of my ministry is to get these cases out of the courtrooms."

    Distasio, a self-professed pagan friar, is representing himself on 74 charges. He said he's the leader of a church called Arcadian Fields Ministries, and that some of his congregants are among the victims in his case.

    The judge told Distasio to confine his arguments to secular laws at his trial, scheduled to begin Sept. 11.

    "If you want to challenge the law, that's your right to do so," Judge Kathleen Sutula said. "But we're going to follow the laws of Ohio in this courtroom."

    Cuyahoga County Bill Mason said Distasio was arrested after he wanted to write a blog for the Lakewood Library. Officials noticed something was wrong and notified Rocky River police.

    Distasio was arrested on charges he molested two disabled boys he was tutoring at his home. He's also accused of raping seven other autistic children at a Cleveland school for special-needs students, The Plain Dealer reported. All but one of the boys was under 13, which carries a mandatory life-in-prison sentence if he is convicted, the paper reported.

    Police said they found journals at Distasio's apartment in which he described his illegal activities, along with child pornography and videotapes of him engaged in sex with boys, The Plain Dealer reported

    "Not all pedophilia is bad, and sex [with boys] can be healthy," Distasio told the court.

    According to the journals, two of Distasio's victims were so helpless they could never tell anyone what happened.

    "The defendant describes acts in which he had autistic children and he did what I would call sadistic sexual acts with these children," said Mason.

    The school he ran from his apartment was called Class Cutters. According to Distasio's Web site, students and parents chose the curriculum in the school for unique children.

    But prosecutors said it was little more than a trap that snared one victim and then another.

    "Like all predators, he used this one child to bring other children to him and that's what was happening, and that's how he got his second victim," said Mason.

    And prosecutors believe there may be more victims.

    Distasio has a history of working with children dating back 10 years.

    Prosecutors said he could be sentenced to life in prison if convicted.

    In a similar vein--we have a show here documenting police activity-last weeks show it showed the police called to a violent young P.O.S--he had seriously assaulted a service station worker -he head butted a young cop in the face, breaking his nose-he resisted arrest and was drunk and obviously disorderly plus several other charges. All of which was on camera. He went to court and was fined $100! That was the extent of punishment-$100. And as this P.O.S was unemployed(probably unemployable)-this would be paid at $5 a week from his benefit.


    If I drive my car with no seat belt--I get an instant $150 fine--no ifs, no buts, no maybe's.

    Interesting world we live in.

    I read earlier this week of a move afoot in Denmark (if I recall correctly) for a political party to be placed on the ballots.

    Their big move is to lower the age of consent to 12 and allow 12 year olds to vote. They feel that children can make those mature decisions like having sex with some pathetic twit, scumbag that like boys and get a decent love interest in his life.
