    Default LODD definition?

    Well I was talking to my friends recently about an old case with a junior from PA getting killed while responding on his bike back in 2002. Originally it was NOT declared as a LODD.

    "ON MAY 4,2002,THE BROOKHAVEN,PA VOLUNTEER FIRE COMPANY WAS DISPATCHED TO A BUILDING FIRE..HEARING THE ALARM,14 YR OLD JUNIOR FIREFIGHTER CHRIS KANGAS JUMPED ON HIS BIKE TO ASSIST HIS FELLOW FIREFIGHTERS.BEING A JUNIOR FF HE WAS ONLY PERMITTED TO ASSIST WITH OUTSIDE OPERATIONS,WHICH ARE AS IMPORTANT AS INSIDE OPS.HE NEVER MADE IT.ON THE WAY TO THE FIREHOUSE,HE WAS STRUCK AND KILLED BY A 16 YR OLD DRIVER.THE ENTIRE FIREFIGHTING COMMUNITY WAS IN SHOCK OVER THE OCCURANCE.WHAT IS MORE SHOCKING IS THAT THE US DEPT OF JUSTICE DENIED IT BEING A LINE OF DUTY DEATH DUE TO HIS AGE,THEREFORE PREVENTING HIS MOTHER FROM AQUIRING FEDERAL DEATH BENEFITS.THAT WAS UNTIL MARCH OF THIS YEAR WHEN FEDERAL APPEALS JUDGE MARIAN BLANK HORN RULED IN THE FAVOR OF THE LINE OF DUTY DESIGNATION.THE RIGHT TO APPEAL THE DESCISION WOULD HAVE EXPIRED JUNE 3,2006 MAKING THE DESCISION PERMANENT.TODAY MAY 31.THE DEPT OF JUSTICE FILED THE APPEAL,ONCE AGAIN BLOCKING THE BENEFITS AND KEEPING CHRIS KANGAS' NAME FROM BEING FOREVER IMMORTALIZED AT THE NATIONAL FALLEN FIREFIGHTERS MEMORIAL IN EMMITSBURG,MD"

    So I was curious as to what people here thought. It's about 50/50 so far, and I was wondering how many people thought it should or should not be a LODD.

    By the way it was later over ruled and considered a LODD, but what do you all think?
