    Arrow Septic Tank=Load of Crap

    Chief can remain in job, despite embezzlement charge
    BENNINGTON, Vt. (AP) - A fire chief can keep his job, despite
    charges he embezzled department funds.
    Officials with the Prudential Committee of the Bennington Rural
    Fire Department say there are no rules that would have allowed
    action against Chief Joseph Hayes.
    Hayes was accused last week of charging a $125 septic tank cover
    to the fire department last May and then keeping it for his
    personal use.
    He told police Lt. Paul Doucette the septic tank cover was for
    his home, but that he charged it to the department because he
    didn't have the money on him.
    The only way Hayes could be removed is for him to suspend
    himself, or the public could petition for a special election,
    Prudential Committee Chairmay Gary Towne said.
    "We have no bylaws in place, therefore the Prudential Committee
    cannot do anything at all. As far as the Prudential Committee is
    concerned, Joe Hayes is the chief," Towne said Tuesday.

    My old volunteer department has a concrete compactor they acquired in a similar fashion.
    The contractor building the new station wanted one and bought it on the department's tax exemption but never used it on our job.
    The Board of Trustees saw the $35K entry on the ledger and started asking questions the guy couldn't answer so they sent the Sheriff and a flatbed wrecker to the construction yard to get it.
    They might have sold it by now.No one said anything about it the last time I was in the Paducah area.Otherwise,it's gotta be the only piece of paving equipment with a fire department logo on it.

    But, Bennington has been known to be a bit "different", from the rest of Vermont. Actually, that whole area of the state, tends to lean closer towards the thought processes of New York, Mass., and New Hampshire. The "real" Vermont starts about 100 miles north of Bennington!!

    Isn't embezzlement or misappropriation of puiblic funds a crime? Why does it matter what rules the FD has in place over this?

    At a minimum this chief should serve some suspension time and pay this back. But honestly I think he needs to be done as chief because this action has damaged his image and laid the seeds that he can no longer be trusted with public money.

    You're kidding, right?

    Two reasons he should forfeit his position.

    1. It is a privelege to be a fire fighter and fire fighters should be held to a higher standard.

    2. The Chief has a fiduciary responsibility over the FD's monies. If he can't be trusted with a $125 spetic tank cover, how can he be trusted with the major expenditures?

    Ok. So....

    Most states have rules that would require a public employee found guilty of a crime involving a breach of public trust to forfeit his position. In VT, otherwise famous as the land where Herbie, Rudolph and Yukon filmed the "Island of Misfit Toys" scene, the laws are so screwed up that this crime goes virtually unpunished.

    The answer to your question? Because it's Vermont. It's that simple.

    I asked the question simply because I thought I knew the answer about the legality of it but wondered how the board could say with a staight face they couldn't do anything about it. I know what would happen if this chief did this in my village. Without a doubt the chief would be terminated and charges would be filed. End of story.

    By the way...just so I don't get accused of having a double standard because of my hard line in the "FD vandalized by the cops topic" I believe that this chief should be terminated and prosecuted and the value of the misappropriated funds is irrelevant in my mind. The value of the destruction of public trust is actually a far greater loss than the cost of the cement septic tank cover. And George, you are absolutely correct we must be held to a higher standard even though many simply don't see it that way.

    Now thats a funny thing about maple syrup, because I get a lot of folks from the west coast in particular, but a few "down here" too, asking me to bring some back from Quebec {of all places}. Seems to me a tree is a tree, mostly because I dont eat the dang stuff anyhow..... but ya know, differ'nt folks 'n strokes and all.
