This is kinda a hypothetical question in regards to civil service laws of New York State. Can departments legally hire firefighters that are not on a current list and consider them part time at 40 hrs a week. Then after the test, they receive a passing score, can they then hire them full time. Is this an acceptable practice? Im sure I left some grey area, but generally this seems to go against the whole idea of civil service.

In NYS, civil service allows for multiple list,temporay appointments and other crazy configrations. The long and short of your question is yes they can, but there are guidelines thay have to follow. The best thing to do is contact your local civil service commision or the state rep for your area.....the state will be a little less forthcoming unless you are a union offical or the cities offical contact for civil service.
