Can some one out there help. We have a physical agility test that has to be taken once a year by everyone . Not everyone is able to pass the test and no one seems to care because they are affraid of a law suit . I need to know where to find the info to support test and legally how to make work.

While it hard to argue with Gold's Gym, I'll bite.
Whats the test and why are people having a hard time passing it?

Hmmm...If you can cut the mustard at a CPAT/agility, please justify why I should let you ride the big red truck and do the job for real?

First, are you asking to modify your test so everyone can pass it? Could the reason that not everyone is passing it is because they don't have the physical stamina to do so?
What's the basis of the test?

Physical Agility Test
The test is not out of the ordinary. 98% of the department can pass it . The higher ups are worried that we will be sued. I am having a hard time finding info for the state of GA on cases that have been brought up on this subject . I do agree that if they can not pass a PAT then they should noy be allowed to ride the truck and that is why I am asking for some help to find the info I need to move foward and force the issue.

Although the case can be made that there are jobs for everyone on a scene, taking up a seat when you are not capable of the job can be a dangerous thing for everyone. Worried about a lawsuit over limiting someones service because they are not physically qualified (either by choice or circumstances) for the job? How about the lawsuit when someone is seriously injured or killed? Our job is a physically demanding one, and when so many of our LODD's are heart/health related, it's time to take off the kid gloves and get real.

Start reading here, the CPAT was developed to be legally defensible.
Also, it was developed so that anyone can pass it.

I believe if the agility test was not in place before the people were hired then they can not be touched but anyone hired post agility test was implemented they should have to pass it.

No Way
I cant believe that you would think just because some one has been in the department so long they dont have to test . It does not matter how long you have been in a department . If you still fight fire then you should be physically able to do it and not put the lives of you brothers in danger , Or is your life the only one you care about.

I have to go through 3 physical agility tests per year.
