Settlement in Fatal Ky. Fire Truck Crash Reaches $3.75M

A Lexington fire truck was not responding to a call when the 27-year-old woman was hit.

Jan. 01--The husband of a woman who was killed by a fire truck in downtown Lexington has reached a settlement with the city and an insurance company for $3.75 million, according to documents received Tuesday by the Herald-Leader.

The Lexington-Fayette Urban County Government has agreed to pay Peter E. Roady $2 million and National Indemnity Co. will pay a total of $1.75 million.

Roady received $1.25 million from the insurance company after the agreement was finalized Nov. 8. The remainder will be paid in monthly installments of $5,404, compounding at 3 percent annually, for 40 years or until his death. The first payment is due Wednesday.

Lauren Woodall Roady, 27, of Washington, D.C., was hit by the Lexington Division of Fire's Engine 9 as she was crossing South Broadway at West Main Street near Triangle Park on Dec. 8, 2012. She was pronounced dead at the scene.

The fire truck, driven by firefighter Christopher Presley, was making a left turn from West Main Street onto South Broadway when Roady was hit. The truck was not on an emergency run at the time of the accident, and its lights and sirens were not activated.

An investigation concluded that Roady had the right-of-way and that Presley's vision was impaired because of rainy weather, fog and blind spots.

Presley, 41, has been on paid leave since the accident and recently announced his retirement, Susan Straub, a spokeswoman for the city, said Tuesday in an email. He has applied for disability through the pension board, she said.

Lauren Roady, an attorney for the U.S. Nuclear Regulatory Commission in Washington, was in Lexington with members of her running club to compete in a cross-country event at Masterson Station Park. She was on the way to a pub on North Broadway to meet her teammates when she died.
