March 12--A Midland man put two children in danger when he set a woman's clothes on fire after she refused to have sex with him, according to court documents.

Armin Rubio, 31, was arrested Sunday on two state jail felony charges of endangering a child with criminal negligence. His bond is set at $100,000.

Midland County deputies responded to a disturbance at about 4:30 a.m. in the 1500 block of West County Road 121.

One deputy saw a fire on the porch of a residence with flames about 5 feet high; a flammable wooden roof was above the blaze.

The deputies detained Rubio, who was very intoxicated. Rubio said he was upset because when he arrived home earlier in the evening, he tried to have sex with a woman at the home and she refused. He became angry and started gathering her clothes and ignited them on the front porch. He said he then went back into the house to gather more of her clothes to fuel the fire.

A deputy said the fire was about 4 feet away from a propane grill with a full tank. Two children, 7 and 9, were inside asleep on a couch near the front door.

If convicted, Rubio faces up to two years in prison for each charge.
