The fire occurred on Elmwood Avenue on July 24 and resulted in the deaths of Lt. Steven Velaquez and Firefighter Michel Baik.

The medical examiner's office for the state found Valesquez died from smoke inhalation and asphyxia and Baik died from smoke inhalation that was complicated by a heart condition.

OSHA found the department did not perform tests on breathing apparatus, failed to conduct medical evaluations, failed to ensure that firefighters wore breathing equipment inside the fire and failed to follow "Mayday" procedures.

The department has 15 days to contest the charges.

If the charges are not contested, the department must submit evidence to OSHA by March 14 showing that the violations have been corrected.

The state division of OSHA began the inspection of the fire in the days following the fire and concluded on Jan. 20. If the charges are upheld, each of the violations will carry a $1,000 penalty.

"I'm just angry, but it doesn't matter what they cite them for it's not going to bring my husband back," Velasquez's widow, Marianne, told the newspaper. "What I would like is changes so nobody else has to go through what Laurie (Baik) and I are going through -- so the death of my husband means something."
