March 04--A lawsuit filed by Pittsburgh Fire Bureau captains, battalion chiefs and deputy chiefs against the city which sought more than three years' worth of overtime pay has been settled, according to a document filed today in U.S. District Court.
Terms of the settlement were not revealed in the document. Attorneys for the firefighters and the city could not be immediately reached.
Three firefighters filed the lawsuit and 50 others opted in, claiming that the city owed them overtime since mid-2009.
According to the complaint, since that time they have not only had to fight fires but also respond to medical and other emergencies.
Because they are not managers under the law, the firefighters said, time worked beyond the Fair Labor Standards Act threshold of 212 hours over 28 days should have been compensated at time and a half.
The firefighters sought back overtime pay, other damages, interest and attorney fees.
Mediator Sally G. Cimini filed a notice that the case settled at a Jan. 18 session. All city settlements must be approved by council before they are final.
