Driver who Struck, Killed Iowa Firefighter Suing Town

The motorist is claiming the Shelby, Iowa firefighter was under the influence of drugs.

The driver who struck and killed a volunteer firefighter is suing the city of Shelby, alleging the man was under the influence of drugs.

Shelby Firefighter Michael Collins, 41, was directing traffic on I-80 when he was killed in September 2011.

David Thies filed a suit in Pottawattamie County small claims court seeking $5,000 plus any extra relief the court sees fit, according to The Republic.

Thies, who was never charged in the death, said he developed PTSD and is still in therapy.

The lawsuit claims Collins' toxicology reports show he had prescription painkillers in his system and tested positive for the active ingredient in marijuana, the paper reported.

Collins was survived by a wife and two young daughters.
