N.H. Prosecutors Will Retry Cold Case Arson Again

N.H. prosecutors have decided to retry a man accused of killing a Keene family in a 1989 house fire they say he set. The first trial ended in a hung jury.

Dec. 23--Prosecutors with the N.H. Attorney General's Office will retry a man accused of setting a fatal fire on Keene's High Street in 1989.

A retrial in the case against David B. McLeod is scheduled for April 14, Senior Assistant Attorney General Janice K. Rundles said today.

McLeod, 57, of Sacramento, Calif., is charged with four counts of second-degree murder in connection with the deaths of four members of the Hina family.

Prosecutors allege McLeod intentionally started a fire at 88 High St. in Keene on Jan. 14, 1989, and recklessly killed 49-year-old Carl R. Hina, his wife, Lori Michelle, 26, their 4-month-old daughter Lillian Marie, and Carl's 12-year-old daughter Sara Jean. Carl and Lori were married just two weeks earlier, on New Year's Eve.

After nearly two days of jury deliberations, Cheshire County Superior Court Judge John C. Kissinger Jr. declared a mistrial in the case Thursday. A jury of nine men and three women could not reach a unanimous verdict, Kissinger ruled.
