Bronx Fire Victims Plan $110M Suit Against FDNY and NYC

The claim says FDNY should have maintained the hydrants and followed up on problems with a smoke detector and fire escapes.

Nearly a dozen victims of the fire that killed 13 in the deadly Bronx fire have filed a notice of claim saying they plan to sue New York City for a combine total of $110 million. The plaintiffs alleged the city failed to follow up on several problem related to the apartment building.

According to the New York Daily News, the victims of the Dec. 28 blaze on Prospect Ave. says the city should have taken the toddler who started the deadly fire away from his mother for not watching and taking care of her child.  The newspaper reported the mother was a person known for being inattentive of her children. The fire was caused by the toddler playing with a stove.

The suit is aimed at FDNY, the city’s Housing Preservation and Development Department and the Administration for Child Services Department.

The complaint also says the city should have kept the fire hydrants around the building maintained and made sure they were not frozen and should have followed up on a faulty smoke detector and made sure the fire escapes were working as well, the newspaper reported.

The court documents were filed on Thursday within 90 days of the event to preserve the right to file a lawsuit, the paper reported.
