The news station obtained a letter Fire Chief Brian L. Cummings sent to City Councilman Dennis Zine that says the misconduct falls outside of the two-year statute of limitations sets in the city charter.

"The Fire Department cannot suspend, remove or separate a sworn member from service for acts that are over two years old," Cummings wrote.

Zine had requested an update on the investigation and said he was told the department plans to leave it open indefinitely and will not have to reveal and of its findings.

"Whatever happened, they basically have clemency," the councilman told the news station. "We need to look at changing this part of the city charter."
