NEW YORK -- A firefighter injured by construction debris five days after a fatal fire at the problem-racked Deutsche Bank tower is suing the owner of the infamous Ground Zero health hazard.

Neil Nally, 35, says he suffered a serious neck injury last Aug. 23 when debris rained down from a forklift that accidentally dropped from an elevator 23 floors up.

A grand jury is looking into bringing criminal charges against companies contracted to tear down and decontaminate the building.

Nally's suit seeks unspecified money damages against the Lower Manhattan Development Corp. and contractors Bovis Lend Lease and John Galt Corp. All three declined to comment.
