Feb. 02--PAWHUSKA -- A young man from Skiatook pleaded guilty recently to a December burglary at the Avant fire station in which the primary truck for the rural Osage County volunteer department was stolen and destroyed.
Harvey Gene Eastwood waived the right to a preliminary hearing and trial on Jan. 17, which -- coincidentally -- was his 20th birthday. The four-part felony charge against him included two counts of second-degree burglary as well as single counts of larceny of a vehicle and third-degree arson. Eastwood also entered a guilty plea to a separate charge of second-degree burglary involving a 2013 break-in at an Avant church.
Osage County Special Judge Stuart Tate accepted the plea with a stipulation that Eastwood had no previous felony convictions. The judge deferred sentencing for one year, to Jan. 16, 2015. Tate issued an order for Eastwood to be committed into the Oklahoma RID (Regimented Inmate Discipline) Program, a boot camp-type incarceration alternative designed for youthful offenders. An offender accountability plan also will be required as part of the delayed-sentencing judgment, district court records indicate.
One year previously, on Jan. 17, 2013 -- the 19th birthday of the Bartlesville-born man -- Eastwood was sentenced to two years probation under supervision of the Tulsa County District Attorney's Office. That judgment was issued in connection with Eastwood's plea of guilty to reduced misdemeanor charges stemming from his arrest for larceny and malicious burglary at a Tulsa auto salvage in December 2012.
Approximately a week before the Osage County charges were filed against Eastwood on Dec. 17, Tulsa County authorities initiated revocation proceeding involving a two-year deferred sentence Eastwood received in the earlier case. Court documents indicate the action was taken as a result of the defendant's failure to comply with terms of the delayed sentencing agreement.
Eastwood had been in custody at the Osage County Jail since his arrest less than a week after the Avant Fire Station was vandalized during a nighttime burglary Dec. 3. The next day, the main truck used by the department's emergency responders was found overturned and burned a few miles from the station.
Losses were estimated at more than $125,000 from the burglary, vandalism and arson incidents.
