February 18, 2004 -- The Manhattan district attorney has launched a probe into the death of two men from carbon monoxide poisoning at a Murray Hill apartment building.

Two female tenants of 535 Third Ave. remained in critical condition at Jacobi Hospital yesterday as DA Robert Morgenthau's office began investigating Sunday's horror.

"We are taking a look at it to determine whether there is negligence involved and, if so, whether that negligence rises to the level of criminality," said spokeswoman Barbara Thompson.

Fire officials have confirmed that in 1999, the building was evacuated when "the same thing happened." There were no fatalities.

"Even at that point, they never put in the carbon monoxide monitors," said tenant Charles Wojciechowski, 33.
