Mistrial Declared in Baltimore LODD Arson after Jurors Deadlocked

"Today's outcome is deeply disappointing for the families of Lt. Paul Butrim, Lt. Kelsey Sadler, and EMT/Firefighter Kenny Lacayo, whose lives were tragically cut short in the Stricker Street fire in 2022," Baltimore City State's Attorney Ivan Bates said.

A mistrial was declared Tuesday after jurors were unable to reach a verdict in the case against a man charged with setting a rowhouse fire that killed three Baltimore firefighters.

The judge's declaration came on the fifth day of deliberations after jurors sent another note saying they were split and could not reach a unanimous verdict.

Their first note about the deadlock was sent Friday, WBAL reported, adding that they were told to continue their discussions.

"We reviewed the evidence again and we remain split. We are unable to reach a unanimous decision based on the evidence presented," jurors wrote Tuesday.

James Barnett, 58, was facing nine charges including manslaughter and arson for the Jan. 23, 2022, that killed three Baltimore firefighters and seriously injured another. Murder charges were dismissed by the judge at the conclusion of the state's case.

State's Attorney for Baltimore City Ivan Bates said he will consider whether to try the case again.

"Today's outcome is deeply disappointing for the families of Lt. Paul Butrim, Lt. Kelsey Sadler, and EMT/Firefighter Kenny Lacayo, whose lives were tragically cut short in the Stricker Street fire in 2022," Bates said in a statement. "While this is not the outcome we sought, our commitment to these families and to pursuing justice has not changed."
