Bucks County, PA, Arson Suspects Not Charged with Firefighter's Death

While three men have been charged in connection with an arson in Bucks County last month, they won't be held responsible for the death of a fire police captain who died of injuries from a fall.

Gavin Ross Montoya, 27, Charles William Vandenberg, 50, and Thomas J. Parker, 36, were each charged for their roles in the arson and conspiracy, CBS Philadelphia reported.

A Bristol Township Police officer saw a white work van burning, and flames quickly spread to a house. Five residents were evacuated safely.

investigators found surveillance footage that showed Montoya lighting a flare and throwing it into a van parked in the driveway. Officials said Vandenberg solicited Montoya while Parker drove him to and from the incident.

Third District Fire Police Capt. Ed Margavich, 80, who was assisting firefighters by shutting down a road at the scene, fell while returning to the firehouse to get more traffic cones.

He died on Aug. 15 due to complications from his leg fracture. 

Prosecutors determined they couldn't charge the three suspects with Margavich's death.

The District Attorney's Office joins the community in mourning the loss of Captain Margavich, who devoted nearly 65 years to serving and protecting others. His dedication saved and protected countless lives and properties and his absence will be deeply felt by all who knew him," the DA's office wrote in a news release.
