Florida Fire Battalion Chiefs Face Misconduct Charges

Two Orange County Fire Battalion Chiefs were on paid leave Tuesday morning following their suspension on misconduct violations.

David Agan and Mike O'Toole could both be fired based on the allegations filed by a female firefighter. A 22-page professional standards review focused on an incident in early 2006. It offers evidence, but not proof that O'Toole may have tried to fondle a female firefighter.

The report accuses Batt. Chief Agan of witnessing abusive behavior and language, and not reporting the actions.

"The report speaks for itself and we are terribly disappointed in some of the charges and accusations made," said Chief Vince Preston of the Orange County Fire Rescue.

The two were to remain on paid leave until a hearing determines their punishment.
