The estate of Rocky Mount firefighter killed in a fatal apparatus crash two years ago has filed a lawsuit against the estate of the fire chief that died with him in the wreck.
The estate of Firefighter William D. "Danny" Altice filed the $2 million lawsuit against the estate of Fire Chief Posey W. Dillon in connection with the collision that occurred on July 26, 2010, according to The Franklin News-Post.
Dillon was at the wheel of the fire truck that was traveling east through the intersection of Route 40 East and School Board Road as an SUV pulled out into the intersection, causing the collision.
The fire truck then hit the curb on the other side of the road and flipped, landing on top of another vehicle.
Both Altice and Dillon -- who were responding to a fire call -- were thrown from the apparatus.
Christie A. Altice-Weaver, the executor of Altice's estate, filed the suit in Franklin County Circuit Court that also names the driver of the SUV, Teri Anne Valentine, as a defendant.
The lawsuit alleges that Dillon was" negligent, grossly negligent, careless and reckless" while operating the vehicle.
Valentine, who was not charged in the crash, has filed a cross lawsuit against Dillon's estate.
